These terms cover the purchase and use of CLEAR, a 7-day digital course offered by Nicholas Malin. By completing your purchase you agree to these terms. Please read them before buying.
Who These Terms Apply To
These Terms and Conditions govern the purchase and use of the digital product CLEAR sold via nicholasmalin.com. They form a legally binding agreement between you (the purchaser) and Nicholas Malin, a sole trader operating in the United Kingdom.
Business name: Nicholas Malin
Address: 8 The Stalls, Corsley, BA12 7NE
Email: info@nicholasmalin.com
You must be 18 years of age or older to purchase CLEAR.
The Product
CLEAR is a 7-day self-directed digital course delivered via a web-based platform at nicholasmalin.com. The course includes:
- 7 daily lessons covering language patterns and practical tools
- Interactive exercises, writing prompts, and daily challenges
- A 7-day email reminder sequence (and optional SMS reminders if a phone number is provided)
- Ongoing access to the course content at the price paid
The content and structure of CLEAR may be updated or improved over time. Purchasers will generally have access to updates where these improve existing content. Significant new products may be offered separately.
CLEAR is an educational and self-development product. It is not therapy, counselling, or medical treatment, and is not a substitute for professional mental health support. If you are experiencing significant mental health difficulties, please seek support from a qualified professional. The Samaritans are available 24 hours a day on 116 123 or at samaritans.org.
Price and Payment
The price of CLEAR is displayed on the sales page at the time of purchase. Prices are in GBP and include any applicable taxes. The price may change over time. The price you pay at the time of purchase is the price you pay — there are no recurring charges.
Payment is processed securely via Stripe. Nicholas Malin does not store or handle your card details directly. By completing payment, you authorise the charge to your chosen payment method.
Access
Upon successful payment, you will receive access to CLEAR via the email address provided at checkout. Access is granted to you as an individual and is strictly personal and non-transferable.
- You may not share your login credentials or course access with any other person
- You may not resell, redistribute, or sublicense any part of the course content
- You may not reproduce or publish course materials — in whole or in part — without written permission from Nicholas Malin
Reasonable efforts are made to ensure uninterrupted access to the course, but occasional downtime, maintenance, or technical issues may occur. Access may be suspended or terminated without refund where these terms are materially breached — including credential sharing, piracy, or abusive conduct.
Ongoing access means access for as long as this product is actively maintained and hosted. In the unlikely event the product is retired, reasonable advance notice will be given.
Cancellation Rights and Digital Content Waiver
Under the Consumer Contracts Regulations 2013, you ordinarily have the right to cancel a digital purchase within 14 days. However, CLEAR is delivered immediately upon payment. By completing your purchase and accessing the course, you acknowledge that immediate delivery has been requested and that your 14-day statutory cancellation right is waived from the point access is granted.
This is standard for instantly delivered digital products and does not affect the money-back guarantee described below, which is offered separately and is more generous than the statutory default — you can request a refund simply by emailing us if the course doesn't deliver value.
Your statutory rights as a UK consumer are not otherwise affected by anything in these terms.
Refund and Money-Back Guarantee
CLEAR comes with a straightforward money-back guarantee. If you complete the course within 30 days of purchase and do not feel it provided value, you are entitled to a full refund.
To request a refund, email info@nicholasmalin.com with the subject line "CLEAR Refund Request." There is no lengthy process. Refunds will be processed within 5–10 business days to the original payment method.
Please note:
- This guarantee applies to requests made within 30 days of purchase
- It is offered on the basis that you have genuinely engaged with the course
- Requests made before completing the course are considered on a case-by-case basis — please get in touch and explain your situation
- This guarantee does not affect your statutory rights as a consumer under UK law
Acceptable Use
CLEAR is for personal development purposes only. By purchasing, you agree to use the course solely for your own personal, non-commercial use. You agree not to:
- Share, copy, or distribute any course materials
- Use the content for commercial purposes, training delivery, or group facilitation without written permission
- Attempt to reverse-engineer, scrape, or systematically extract the course content
If you are interested in using CLEAR within an organisational or group context, please contact info@nicholasmalin.com to discuss licensing arrangements.
Intellectual Property
All content within CLEAR — including text, structure, exercises, terminology, and design — is the intellectual property of Nicholas Malin and is protected by copyright. Nothing in these terms grants you any ownership of or licence to the underlying intellectual property beyond the personal right to access and use the course for your own development.
Results and Outcomes
CLEAR is educational in nature. Individual results vary and depend on engagement, practice, and personal circumstances. No specific outcome, result, or transformation is guaranteed. Testimonials reflect individual experiences and are not a promise of equivalent results.
Limitation of Liability
To the fullest extent permitted by UK law, Nicholas Malin's liability in connection with CLEAR is limited to the purchase price paid. Nicholas Malin is not liable for any indirect, consequential, or special losses arising from your use of the course.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or anything else that cannot lawfully be excluded under UK law.
Force Majeure
Nicholas Malin is not liable for any delay or failure to provide access to CLEAR caused by circumstances beyond reasonable control — including but not limited to hosting outages, internet disruption, platform failures, illness, or other events outside Nicholas Malin's reasonable control. Reasonable efforts will be made to restore access as quickly as possible.
Governing Law
These terms are governed by the laws of England and Wales. Consumers retain the right to bring proceedings in their country of residence where applicable under UK consumer law.
Changes to These Terms
These terms may be updated from time to time. The date at the top of this page reflects the most recent revision. Where changes are material, reasonable notice will be given. Continued use of the course after changes are posted constitutes acceptance of the updated terms.
